We use the words “you” and “your” to mean you, the reader, and other visitors to our online and mobile resources who are, in all cases, over the age of 13. Our privacy statement (“this statement,” “this privacy statement,” and “our statement”) informs you about from whom and the types of personal information we collect, how we use it, who we share it with and why, and what we do to try to protect it.
Online and mobile resources mean the websites and other internet features we own that allow you to interact with our websites, as well apps we’ve created and distributed to let our customers and followers view our online and mobile resources or otherwise interact with the content we provide.
Who We Collect Personal Information From
We may collect personal information from the following groups: visitors to and users of our online and mobile resources; applicants and customers; current members of our workforce and those who apply for posted jobs; and third-party vendors and business partners.
Personal information generally means information that can be used to identify you or that can be easily linked to you, for example your name, address, telephone number, email address and date of birth. Some privacy laws, such as the California Consumer Privacy Act ("CCPA") and the European General Data Protection Regulation ("GDPR"), include additional elements in their definitions. Where those laws apply to us, our use of "personal information" includes those elements.
The categories we collect from each group, and how we use them, differ. The same person may fall into more than one group. Most of this statement covers visitors, users, applicants and customers.
What We Collect
We obtain two types of information from you online:
(i) non-personal information collected automatically from each visitor, such as your device's operating system; and
(ii) personal information that you voluntarily provide or that is collected automatically.
By using our online and mobile resources or purchasing our products or services, you agree to this section and to our use and disclosure of your information as described.
Voluntarily Submitted Information
If you take part in certain activities on our online and mobile resources, you may be asked to give us information about yourself. This can include identifiers (such as your name, email address, physical address and phone number), professional information, and payment information. We do not sell, rent or trade voluntarily submitted personal information with third parties.
If you don't want us to collect this type of information, please don't provide it. That means you shouldn't take part in the activities that request it. Participation is strictly your choice. Not participating may limit your ability to use some features, but it will not affect your ability to view information available to the general public.
Some of the ways you give us personal information, and how we use it:
Emails and online forms. When you email us or fill out a form, such as an application, we keep your email address and any other personal information in your message and use it to respond to you and process your request. Depending on what you provide, we may contact you by email, phone call, or text message. We may also send you information about products or services we think may interest you.
Registering for an account. When you register, you give us details such as your name and email address. We use them to create and manage your account and to communicate with you.
Registering for events and calls. When you register for webinars, events, programs or strategy calls we host, we collect the identifiers described above and use them to register you and send communications about the event or call. If a fee applies, payment details are handled as described under "Payments."
Becoming a customer or student. We use information from customers to perform our contractual obligations, provide the products and services purchased, manage accounts and communicate with them.
Community features. Some resources may let you post messages, comments or files. Information you post, including your screen name and any personal information in it, will be public and is not covered by this statement.
Automatically Collected Information
When you visit our online and mobile resources, basic information is collected through your browser using tracking technologies such as cookies, which are small text files placed on your computer or mobile device. They let us recognize your device and store some information about your preferences or past actions.
We allow third-party vendors to use cookies or similar technologies to collect information about your browsing over time. For example, we use Google Analytics, a web analytics service provided by Google, which uses cookies to help us analyze how you use our resources. Information collected this way includes: the domain name and IP address you used to access our resources; browser type and operating system; the date, time and length of your visit; pages visited, graphics viewed and documents downloaded; and the links you followed to and from our resources.
If you access our resources from a phone or other mobile device, your mobile provider may send us uniquely identifiable device information, which lets us collect mobile phone numbers and associate them with the device. Some mobile vendors also pinpoint the physical location of devices, and we may receive this information if location services are enabled. If you do not want us to collect geolocation data, disable location services in your device settings.
We use automatically collected and mobile device information to compile generic reports about popular pages, to see how customers and followers access our resources, to administer and improve them, and to make your use more convenient, such as by remembering certain information to save you time.
We use and retain your personal information in accordance with applicable law and for as long as necessary for the purposes described here, under our internal data retention procedures. Usage Data is generally retained for a shorter period, except where it is used to strengthen security or improve the functionality of our service, or where we are legally required to keep it longer.
External Sites, Apps, Links and Social Media
We maintain a presence on external social media platforms such as Facebook, Instagram, YouTube and LinkedIn, and our resources may connect with or link to them and to other third-party sites and apps. We are not responsible for the content or privacy practices of those platforms or sites. They are not controlled by us and have their own privacy policies and terms. If you have questions about how they handle personal information, please read their policies and contact them directly.
How We Use Your Information
GCM Services FZCO may use the information we collect from and about you for a variety of business purposes: in general, to provide our services, improve customer experience and engagement, and develop our services. We process your data only in accordance with applicable data protection law and this statement.
Note that under some legislations, we may be allowed to process information until you object to such processing (by opting out), without having to rely on consent or any other of the following legal bases below. In any case, we will be happy to clarify the specific legal basis that applies to the processing, and in particular whether the provision of Personal Information is a statutory or contractual requirement, or a requirement necessary to enter into a contract.
You further understand that this is a soft pull and will not harm your credit in any way whatsoever.
We will have a lawful basis for processing your data if:
we need to process your information to provide the products or services you requested or to enter into a contract;
you have consented to the processing;
we have a legitimate interest, such as fraud prevention, direct marketing, network and information systems security, data analytics, improving our services, identifying usage trends, measuring the effectiveness of promotional campaigns, and personalizing the service to make it easier and faster for you to use; and/or
we are legally obliged to process it.
We may use the information we collect for these customer service and transaction purposes:
To provide the requested services to you.
To manage your account.
To personalize your experience and respond to your individual needs.
To improve our website based on the information and feedback we receive.
To diagnose problems with our servers or services.
To improve customer service and respond to support requests.
To process transactions, such as purchases and subscriptions.
To use and disclose payment information only to process payments and prevent fraud.
To administer a contest, promotion, survey or other site feature.
To develop new products or services and enhance current ones.
To send periodic emails about service updates, orders and subscriptions.
To protect the security or integrity of our services and business, including against fraud, unauthorized transactions, claims and other liabilities.
We may use your information for these commercial purposes:
To send you marketing and promotional emails and text messages.
To target prospective customers with our services (only with your permission where consent is required by applicable law).
We may also use information you provide for other purposes disclosed when you provide it, or otherwise with your consent.
When and With Whom We Share Personal Information
We use voluntarily provided personal information to respond to your inquiries and provide the services you requested, among other uses described here. We do not sell or rent your personal information to third-party data vendors or marketing companies. We disclose your information when required by law.
Affiliates. We may share your information within our family of companies. They will use it in generally the same way we do under this statement, which may include sending you information about their products, services or initiatives.
Legally compelled disclosures. We may disclose your information to government authorities and other third parties when compelled to, or as otherwise required or permitted by law, including in response to court orders and subpoenas.
To prevent harm. We may disclose your information when we have reason to believe someone is causing injury to or interference with our rights or property, other users of our resources, or anyone else who could be harmed by such activity.
Business transfer. If we or any of our affiliates, or substantially all of our or their assets, are acquired as a result of an acquisition, merger, sale, reorganization, consolidation or liquidation, personal information may be one of the transferred assets.
Vendors and business partners. We may share your information with vendors and other third parties we have a contractual relationship with, including providers of software services (such as CRM, email, text messaging, scheduling and payment tools) that help us operate. We aim to disclose only what each party needs.
We have adopted standards for vendors and business partners who receive personal information from us and attempt to bind them by written contract. We attempt to restrict what they can do with the information so that it is used only to carry out the business purpose it was provided for, is not disclosed to anyone else without our consent or instruction, and remains our property as between us and the vendor. We cannot guarantee that every vendor will agree to these requirements or fully comply with them.
Email and Text Message Communications
We may use your personal data to contact you with newsletters, marketing or promotional materials and other information that may interest you, by email and, where you have given your number and consent, by text message.
Email: you can opt out at any time using the unsubscribe link in any email, or by contacting us.
Text messages: message frequency varies. Message and data rates may apply. Reply STOP at any time to opt out, or HELP for help. We do not share mobile phone numbers or text messaging consent with third parties or affiliates for their own marketing purposes.
Some messages are transactional or service-related (for example, call confirmations, account notices and billing information). You cannot unsubscribe from those while they remain relevant to your account or booking.
Payments
We may offer paid products or services. In that case we may use third-party payment processors. We do not store or collect your payment card details. That information goes directly to our payment processors, whose use of it is governed by their own privacy policies. These processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council.
Your Rights and Options
You may need to provide personal information to use most features of our resources. You can opt out of certain activities, such as newsletters and announcements. Residents of California, and data subjects in the GDPR Jurisdictions, have additional rights described below.
If you consented to receive direct marketing from us, you can opt out or change your preferences by following the link in the footer of any non-transactional email, by replying STOP to a text, or by emailing [PRIVACY EMAIL]. When we receive your request we will take reasonable steps to remove you from our distribution lists. This may take some time, so you may still receive materials for a short period afterwards. You can also ask to access, amend or delete your personal information by contacting us.
GDPR Jurisdictions means the countries of the European Economic Area (including Iceland, Liechtenstein and Norway) and the member states of the European Union. Andorra, Argentina, Canada (commercial organizations only), the Faroe Islands, Guernsey, Israel, the Isle of Man, Jersey, New Zealand, Switzerland, Uruguay and Japan have received an "adequacy decision" from the European Commission. Switzerland also has its own Federal Act on Data Protection. The United Kingdom is regulated domestically by the UK GDPR.
Some browsers have a "do not track" feature. We do not currently respond to browser "do not track" signals, but we do process Global Privacy Control signals as an opt-out request (see below).
Children's Privacy
We do not intend for our online and mobile resources to be used by anyone under the age of 18. If we become aware that anyone under 18 has submitted personal information, we will delete it and will not use it for any purpose. If you believe someone under 18 has submitted personal information to us, please contact us at [email protected] We encourage parents and guardians to talk with their children about the risks of sharing personal information online.
How We Protect Personal Information
We take reasonable security precautions to protect your personal information. We have adopted a security program with technical, organizational and administrative measures designed to protect against anticipated or actual threats, consistent with accepted industry standards and applicable law. We cannot guarantee that your information will be free from unauthorized access, or that loss, misuse, destruction or alteration will not occur, whether in transmission or in storage. Except for our duty to maintain the security program under applicable law, we disclaim liability for theft or loss of, unauthorized access to, damage to, or interception of any data or communications.
We have incident response procedures that are activated when we become aware that your personal information is likely to have been compromised, and we require vendors and business partners to notify us immediately if they believe an incident affecting personal information we provided to them has occurred.
California Residents (CCPA)
When we collect personal information from California residents, those residents have rights under the CCPA. In this section, "you" means California residents only.
What we collect. Identifiers such as name, address and IP address; personal information described in California Civil Code Section 1798.80(e) such as name, address and telephone number; commercial information such as products or services purchased; internet or electronic activity such as browsing history; geolocation data; and audio, video or similar electronic information. We may disclose this information for business purposes permitted by the CCPA. We do not sell, and in the last 12 months have not sold, personal information to third parties.
Your rights.
Access: up to twice a year, you can request the categories and specific pieces of personal information we have collected, the sources, the business or commercial purpose, the categories disclosed for a commercial purpose, and the categories of third parties we shared it with.
Deletion: you can request that we delete personal information we collected from or about you. In some cases we cannot fully comply, for example where we need the information to complete a transaction, detect and protect against fraud, exercise our rights, or comply with a legal obligation.
If you exercise these rights, we will not discriminate against you. To make a request, contact [PRIVACY EMAIL]. We may ask you to complete a request form, and we can act only if we can verify your identity or authority to make the request. We will confirm receipt and respond within the time frames set by the CCPA.
Virginia Residents
If you are a Virginia resident, you may have rights under Virginia Code 59.1-577, including to access, correct or delete your personal information and to opt out of sales or targeted advertising as defined in Virginia law. You may appeal a denial of your request. To exercise these rights or appeal, contact [email protected]. We may ask you to complete a request form and can act only if we can verify your identity or authority.
The EU General Data Protection Regulation
We obtain personal information from data subjects located in the GDPR Jurisdictions. We meet our GDPR obligations for customers, vendors and business partners through separate notices, contracts or other terms provided at the relevant time. In this section, "you" means visitors and users located in a GDPR Jurisdiction.
What we collect and how we use it. We collect the categories already described. The lawful basis we rely on for collection, use and disclosure is legitimate interest. We do not sell your personal information or use it for automated decision-making.
Cross-border transfers. If we transfer personal information from the GDPR Jurisdictions to a location the European Commission has not deemed to have adequate protection, we do so in the manner the GDPR permits.
Your rights. You have the rights of transparency, access, correction and deletion, portability, restriction and objection. To exercise them, contact [email protected]. These rights are subject to the conditions and exemptions in Articles 12 to 23 of the GDPR, including our right to decline a request if we cannot reasonably verify your identity. We will respond without undue delay and within any time frames the GDPR sets. If you are not satisfied with how we use your information or respond to your requests, you can complain to your data protection regulator.
Online Tracking Technologies and Advertising
We, our service providers and third parties may collect information about your activity on our sites and apps and on third-party sites and apps using cookies, pixels, tags, software development kits, application program interfaces and web beacons, whether or not you are logged in. We may associate this data with your account if you have one.
This data may be used to:
provide useful features that simplify your experience when you return; deliver relevant content and advertising based on your preferences, usage and location; monitor, evaluate, measure and optimize the use of our sites and the advertising you see; and analyze traffic on our sites and third-party sites.
We may use your personal information to deliver relevant marketing and advertising to you on our properties and on third-party sites and apps. We may give social media and other platforms limited personal information, such as certain identifiers or a hashed email address, which they match with their own user profiles. The platform may then show you our ads, find other users who may like them, suppress our ads for you, and give us insights to optimize our advertising.
Some states give residents the right to opt out of the "sale" or "sharing" of personal information, or of targeted advertising. To opt out, email [email protected]with the subject line "Do Not Sell or Share My Personal Information." Your choice may apply only to the specific device and browser you use, and you may need to opt out again if you clear cookies or switch devices. You can also opt out of targeted advertising directly with many ad networks and partners, and control it in your device and platform settings. We adhere to the Digital Advertising Alliance's Self-Regulatory Principles for Online Behavioral Advertising.
Examples of tracking technologies Cookies are pieces of information a website places on your device. They may involve the transmission of information to us, to another party on our behalf, or to another party under its own privacy policy. You can set your browser to warn you when a cookie is placed or to block all cookies; check your browser's Help menu. If you turn cookies off, some features and services may not work properly.
Web beacons and marketing pixels are small pieces of data embedded in images on pages. They may transmit information to us or to another party under its own privacy policy.
Opt-out preference signals. If you enable a universal tool such as the Global Privacy Control (GPC) that communicates your opt-out preferences, we will process it as a request to opt out.
Agent Authorization
You may authorize someone to make a privacy rights request on your behalf. Authorized agents must show that you have authorized them or that they hold power of attorney under applicable law. We may ask you to confirm the agent's authority directly, or ask for additional information to confirm their identity. An authorized agent may not use a consumer's personal information for any purpose other than fulfilling the request, verification or fraud prevention.
Rights of Data Subjects in Other Jurisdictions
In other jurisdictions with similar data privacy laws, we may collect the categories of personal information described above and manage and disclose it in compliance with applicable local law. We do not sell your personal information or use it for automated decision-making.
Changes to This Privacy Statement
This statement is effective as of the date shown at the top. The English-language version is the controlling version regardless of any translation. We may change or update it from time to time, so please check it periodically, as all information collected is subject to the statement in place at that time.
